A large volume of calls and letters to other members of Congress in support of the actions of Representatives Carter and Culberson could start the dominoes falling against Obama.

I wish I had better news to report.

But Newt Gingrich is still refusing to return his National Association for Gun Rights Presidential Survey.

In the end, I guess it really comes as no surprise. I’m afraid Newt’s been about as faithful to the Second Amendment as he has been to his three wives.

In fact, Newt Gingrich has had a long love affair with the anti-gun crowd:

*** Newt supports the Brady National Gun Registry – He stubbornly continues to support the anti-gun Brady Bill, which created a national gun registry;

*** Newt supports a national biometric thumbprint database for gun purchasers – He thinks you should be forced to undergo fingerprinting before you are allowed to purchase a firearm;

*** Newt supports the Lautenberg Gun Ban – He voted to strip law-abiding gun owners of their 2nd Amendment rights for life, simply because they spanked their children or did nothing more than grab the wrist of a spouse;

*** Newt supports the “Criminal Safezones Act” —  He stood shoulder to shoulder with Nancy Pelosi to turn every school in America into a “criminal safe-zone,” where law-abiding adults are disarmed and defenseless while gun-toting thugs are free to commit horrific atrocities like the Columbine Massacre.

Now Newt is trying to sell himself as a “pro-gun conservative.” But with more than three decades as a public figure, Newt is the quintessential political chameleon, shifting his views to reflect whatever is popular with the chattering political class.

His ongoing betrayal is a transparent attempt to pander to the East Coast anti-gun media, and was the hallmark of his tenure in Congress.

While Newt used the institutional gun lobby as a mouthpiece to convince millions of gun owners nationwide that “as long as he is Speaker, no gun-control legislation is going to move in committee or on the House floor,” he was working behind the scenes to pass gun control.

Two years ago, Senator Ben Nelson cut a deal and caved to party pressure by giving the Democrats the 60th vote needed to ram through Barack Obama’s $2.5 trillion government-run health care bill.

Senator Nelson cut that backroom deal with Harry Reid — to get the infamous Cornhusker Kickback — even though he knew it cut Medicare by $500 billion, raised taxes by $500 billion, and was opposed by a strong majority of Nebraskans.

The spending bill funds 10 Cabinet departments.

The 296-121 vote to approve the spending measure represented a rare moment of bipartisanship in a polarized Capitol. The Senate’s top Republican, meanwhile, raised the stakes in the showdown over the payroll tax cut, insisting he won’t back a compromise extension unless the bill includes language aimed at forcing construction of a Canada-to-Texas pipeline.

As negotiations on the payroll tax bill proceeded Friday, Senate GOP Leader Mitch McConnell, R-Ky., said, "I will not be able to support the package that doesn’t include the pipeline."

The GOP’s pipeline demands added uncertainty to efforts by McConnell and Senate Majority Leader Harry Reid, D-Nev., to quickly reach a deal on a bill renewing payroll tax cuts and jobless benefits for the long-term unemployed.

Negotiators on the payroll tax measure worked behind closed doors Friday in hopes of sealing agreement on how to pay for the measure. Simply extending the current 2 percentage point payroll tax cut would cost $120 billion, while extending unemployment benefits for the long-term jobless and preventing a cut in Medicare payment to physicians would add tens of billions of dollars more.

A House-passed version of the payroll tax bill would give President Obama 60 days to decide whether to build the proposed, 1,700-mile Keystone XL pipeline.

Obama, with the support of congressional Democrats, has announced he will delay that decision until after next year’s elections, citing a need to study the impact the pipeline would have on sensitive lands in Nebraska. Obama has threatened to reject a payroll tax bill if it includes language easing work on the pipeline.

The postponement would let Democrats avoid having to choose between two of the party’s core constituencies: environmentalists who oppose Keystone and some unions who covet the jobs it would produce.

But McConnell and other Republicans say the project would create thousands of jobs. The company’s developer, TransCanada, says it could produce up to 20,000 jobs, while critics say the figure would be fewer than 3,500, including less than 1,000 that would be permanent.

After passing the catchall spending bill House leaders sent their members home until Monday or later, planning to return when the Senate produces a payroll tax cut measure for the House to vote on.

The way was smoother for the compromise spending bill, which passed on a 296-121 vote. It would fund 10 Cabinet-level departments, such as the Pentagon and the Department of Education, and dozens of smaller agencies. It would finance everything from U.S. operations in Iraq and Afghanistan to veterans’ services, and from airport security inspections to Congress’ own operations.

Reid and McConnell said that even if only the House had approved the spending bill by midnight Friday, the Obama administration agreed there would be no federal shutdown. For extra measure, the House also passed two stopgap spending bills, one to fund the government for a single day and the other for a week.

Agreement on the spending legislation was reached after Republicans agreed to drop language that would have blocked Obama from easing rules on people who visit and send money to relatives in Cuba. But a GOP provision will stay in the bill thwarting a 2007 law, passed during President George W. Bush‘s administration, on energy efficiency standards that critics argued would make it hard for people to purchase inexpensive incandescent light bulbs.

This year’s 4.2% payroll tax rate will jump back to its normal 6.2% on Jan. 1 unless action is taken by Congress. Few lawmakers want to be blamed for a tax increase that would affect 160 million people.

Extended benefits for long-term jobless people will also expire Jan. 1 without congressional action.

That same day, a 27% cut in Medicare reimbursements to doctors would take effect unless lawmakers act, a reduction that could convince some doctors to stop treating Medicare patients.

Obama and congressional Democrats have proposed dropping next year’s payroll tax rate to 3.1%, but an extension of this year’s 4.2% rate seems likely to prevail. The payroll tax is the major source of financing for Social Security.

Obama also wants to leave in place the current maximum of 99 weeks of benefits for the long-term unemployed. A payroll tax cut bill approved by the House reduces that total by 20 weeks, which the administration says would cut off 3.3 million individuals. Democrats are hoping to soften if not reverse what’s in the House version.

Even without the Keystone pipeline dispute, bargainers had still not reached agreement on how to extend a payroll tax cut through 2012, with major disagreements remaining over how to finance the package.

The spending bill advanced after Democrats blocked a series of GOP assaults on Environmental Protection Agency regulations, though the agency’s budget absorbed a cut of more than 3 percent.

GOP leaders did succeed in delays in regulations of coal dust and eliminating federal funding of needle exchange programs.

War costs would be $115 billion, a $43 billion cut from the previous year.

"Oakland Police responded to a late night call that protesters had broken into and occupied a downtown building and set several simultaneous fires," the statement read. "The protesters began hurling rocks, explosives, bottles, and flaming objects at responding officers. Several private and municipal buildings sustained heavy vandalism."

Police battled with protesters in Seattle, Washington and other cities across America.

This is America, yet here we have protest mobs burning cities, shutting down ports, and attacking our police officers.  And as we’ve reported to you before, one of the more shameful parts of this story is that Democrat politicians have been egging on these violent mobs, in an attempt to stir up the passions of radical leftists, in order to create a counterpoint by the Left against the tea party movement.

According to a UC regarding amendments on the minibus, the defense of germaneness for purposes of Rule 16 will be determined by looking at the House-passed Ag bill; H.R. 2596 for CJS; and S.1596 for THUD.

As of this morning the following amendments are pending to H.R. 2112:

• Reid (for Inouye) #738 (substitute);

• Reid (for Webb) amendment #750 (National Criminal Justice Commission);
• Kohl amendment #755 (report on certain salary and expense account reductions);
• Cornyn amendment #775 (prohibit funding for Fast and Furious/gunwalking programs); and
• Durbin (for Murray) amendment #772 (strike exemption from environmental requirements for certain highway projects).

While no votes have been scheduled on amendments at this point, we DO expect votes today.  We will keep you posted once they are scheduled.

In addition to consideration of the minibus this week, the Senate could also consider the nomination of Heather A. Higginbottom to be Deputy Director of the Office of Management and Budget (Executive Calendar #78).  According to a UC entered last week, there will be up to four hours of debate on this nomination (followed by a vote) at a time to be determined by the two Leaders (we expect this vote could take place tomorrow).

In case you missed it, yesterday evening Leader Reid began the Rule 14 process for S.1723, his stimulus/state bail-out bill with a surtax on small businesses (see text attached).  Leader Reid has indicated he would like to get a vote on this bill before the recess.  We anticipate he could file a motion to proceed on this bill tomorrow setting up a Friday vote on cloture on the motion to proceed.  As always, if a UC is reached, this vote could be moved up.  We will keep you posted as we learn more.  Please note, Leader McConnell also started Rule 14ing S.1726 regarding repeal of the 3% withholding tax.  This bill is identical to the text of S.164, a bill introduced by Senator Brown (R-MA), which was referred to the Finance Committee.

Let’s Try Something That Might Actually Work

‘The American people didn’t send us here to kick our problems down the road. And they certainly didn’t send us here to repeat the same mistakes over and over again — and then stick them and their children with the tab. That might be how you maintain a sense of urgency, by failing to solve the problem the first two times around. But it isn’t how you solve a jobs crisis. The American people deserve better than this.’

Washington, D.C. – U.S. Senate Republican Leader Mitch McConnell made the following statement on the Senate floor Tuesday regarding the President’s failed stimulus and the need for a new approach to solve the jobs crisis:

“It’s no secret that the vast majority of Americans aren’t happy with Washington right now. They say that 13 percent of the public approve of Congress, but I for one haven’t met many of them.

“It’s also no secret that the President of the United States is trying to use this displeasure with Washington for political gain. And I think that’s a pretty sad commentary on the state of affairs over at the White House these days.

“As the only person elected to represent every American, the President should speak for all Americans, especially in times of crisis, not divide them for short-term partisan political gain.

“But it’s perfectly obvious why the President would find the path of division appealing — because on the number one issue we face, jobs and the economy, the President’s policies haven’t worked as advertised.

“After nearly three years in office, he’s failed to make good on his promises to turn the jobs crisis around. And I think you can pretty much sum up that failure with a single number: 1.5 million. That’s how many fewer jobs there are right now in America since the President signed his first stimulus, according to the Obama administration’s own Labor Department: 1.5 million.

“So he’s trying to change the topic.

“He wants to deflect attention from that record.

“He wants people to think that the problem isn’t his policies.  It’s those mean Republicans in Congress who oppose them.

“But the President leaves a few things out of the reelection script that he brought along on his bus tour.

“First of all, it wasn’t just the Republicans who defeated his latest stimulus bill last week.

“The only reason a majority of Democrats voted to debate it is they knew they wouldn’t have to vote for it.

“That’s why the Majority Leader repeatedly moved to block a vote on the measure itself.

“Second: we’re now living under economic policies that President Obama himself put in place.

“This isn’t something you’ll hear on the bus tour, but let’s be clear: the President got everything he wanted from a Democrat-controlled Congress during the first two years of his Presidency.

“Now we’re living with the hard reality that those policies have brought to bear on the American worker.

“So at this point, anytime the President says ‘pass this bill,’ people have very good reason to be skeptical.

“Because this isn’t the first time President Obama’s demanded that Congresses pass what he calls a ‘jobs bill.’

“But if this one were to pass, and it worked as advertised, then it would be the first one that did.

“Again and again, the President’s response to America’s ongoing jobs crisis has been to insist that Congress pass some urgent piece of legislation right away, or an even worse calamity would result. Those bills were supposed to create jobs and prevent layoffs too. But he keeps coming back for more.

“I guess the President is counting on the American people to forget that part. He’s counting on us to forget about the other stimulus legislation he’s already signed into law, and that it’s failed to live up to the hype every time.

“Again and again, the President has demanded that Congress do something to create jobs — and the only thing we seem to end up with at the end of the day is more debt, more government, and fewer jobs.

“Let’s just review the record for a second.

“Two and a half years ago, President Obama went down to Florida and said the first stimulus — the nearly one trillion dollar government spending bill he signed shortly after taking office — would save or create millions of jobs, including jobs for firefighters, nurses, police officers, and teachers.

“What happened?

“Well, the states got their bailout, the national unemployment rate didn’t budge, and a year and a half later, the President was back asking for another one.

“That’s right, a year and a half after the first stimulus, the White House was back last August, saying they needed another $26 billion right away or else 160,000 teachers would get pink slips, and police and firefighters across the country would be off the job.  And what happened then?

“Well, the states got another bailout, the unemployment rate didn’t budge, and now the President’s riding around on a bus saying that if they don’t get another one, teachers, police and firefighters will lose their jobs. Again.

“Anybody notice a pattern here?

“We’ve been doing this for nearly three years now. It doesn’t work as advertised.

“Bailouts don’t solve the problem. They perpetuate it.

“Yet all we get from the President and Democrats in Congress is ‘Do it again — or else!’

“We’ve been mired in a jobs crisis for three years now, and all Democrats ever want to do is throw more taxpayer money at it.

“It never works the way they claim it will.

“And yet they want to keep doing it with other people’s money.

“Just throw another bailout together, slap the word ‘jobs’ on the cover page, and dare people to vote against it.

“That’s the Democrats’ governing philosophy — three years into this jobs crisis.

“It wouldn’t be irresponsible to oppose an approach like this; it would be irresponsible to consider it.

“It didn’t work the first time. It didn’t work the second time.

“The third time won’t be the charm.

“And that’s why Republicans, and a growing number of our Democrat friends, want a different approach.

“There is growing bipartisan opposition to trying the same failed policies again.

“And there’s bipartisan opposition to raising taxes, especially at a time when 14 million Americans are out of work.

“I mean, if there’s one thing we should agree on right now it’s that we should be making it easier for businesses to hire, not harder.

“So, the President should drop his obsession with raising taxes.

“And if he really wants to create jobs, maybe he should consider doing something different.

“They’ve tried the bailout approach.

“They’ve tried more regulations, more debt and more taxes.

“Let’s try a new idea for a change.

“One that has bipartisan support.

“One that isn’t a two-time proven failure.

“Let’s try something that might actually work.

“Because the American people didn’t send us here to kick our problems down the road. And they certainly didn’t send us here to repeat the same mistakes over and over again — and then stick them and their children with the tab. That might be how you maintain a sense of urgency, by failing to solve the problem the first two times around. But it isn’t how you solve a jobs crisis.

“The American people deserve better than this.

“They deserve better than false promises they’re getting.

“The President got everything he wanted from a Democrat-led Congress for two years.

“A health care law that was designed to take over of one-sixth of the entire U.S. economy.

“A financial reform bill that punishes businesses that had nothing to do with the financial crisis.

“Out-of-control regulations that are forcing otherwise healthy businesses to shut down — businesses like Smart Papers in Hamilton Ohio, a paper mill that said last week it’s shutting down because of onerous new federal regulations that make it too costly to do business.

“And a trillion dollar stimulus that was supposed to solve this jobs crisis two and half years ago.

“For two years, when he said ‘Pass this bill right away,’ Democrats acted. And here’s what we got despite all that: trillions in debt and more than a million and a half fewer jobs.

“We don’t need more of that. We can’t afford more of the same.”
